Terms of Purchase of Background Check Services

1. Introduction

Manymore.com AS (org.nr. 923 004 114) (“Manymore”, “we”, “us”) provides technological solutions for background checks and related services for businesses.

This document describes the division of responsibilities between the customer, the candidate and Manymore in connection with ordering and managing a background check.

How this statement is part of our legal framework: This statement is part of Manymore’s legal framework, which also includes the Privacy Policy, Terms of Use, Data Processing Agreement and Service Level Agreement. Together, these documents regulate the use of our services, how we handle data, and our service obligations.

2. Definitions

A background check booking is received when the customer has completed the ordering process and the background check is registered in the platform (my.manymore.com).

The candidate is the person who undergoes a background check on behalf of the customer.

The customer is the business or user who has ordered the background check.

3. Role allocation and processing basis

The customer is the data controller under applicable data protection legislation.
Manymore is a data processor and processes personal data on behalf of the customer in accordance with a data processing agreement.

When ordering, the customer confirms that:

  1. there is a valid processing basis for the background check
  2. the candidate has been informed in accordance with applicable regulations
  3. necessary assessments of proportionality and relevance have been made

When ordering a credit check, the customer confirms that there is a factual need and legitimate interest in accordance with applicable regulations. Information about the terms for credit checks can be read here (Norwegian).

4. Responsibility and obligations

It is the customer's responsibility to provide correct and complete information about the candidate when ordering.

It is Manymore's responsibility to contact the candidate within a reasonable time after receiving the order, within normal working hours, to obtain the necessary information.

It is the candidate's responsibility to provide correct and complete information and to complete the process.

Manymore delivers the service according to the selected package and specification. Manymore does not make any assessments regarding employment, recommendations or decisions. The report constitutes a basis for decision-making, and the final assessment and decision rests with the customer.

5. Cancellation and payment

The order can be canceled at any time before the candidate has given their consent.

Payment is due from the time the candidate has given their consent and the process has started.

If the candidate withdraws their consent or does not complete the process after consent has been given, the service is considered to have begun and can be invoiced according to the current price list.

6. Limitations and Dependencies

The background check is based on:

  1. Information provided by the candidate
  2. Information received from third-party actors, including educational institutions, employers, public registers and credit reference agencies
  3. Available databases and integrated systems

Manymore collects and compiles information, but is not the source of the underlying information. Manymore cannot guarantee that information received from third parties is complete, correct or up-to-date. Manymore is not responsible for errors, omissions or inaccuracies in information that:

  • is provided by the candidate
  • is received from third-party actors
  • appears in external registers or databases

The candidate is responsible for providing correct and complete information. The customer is responsible for making an independent assessment of the information in the report before making a decision.

The background check provides a snapshot based on information available at the time of completion. Manymore is not responsible for circumstances that change after the report is sent.

Manymore is not liable for indirect losses, consequential losses, lost profits or other financial consequences resulting from the use of the service.

Manymore's total liability related to a specific background check is limited to the amount the customer has paid for the check in question.

Manymore provides a technological tool and a compilation of information obtained. Manymore does not perform:

  • Suitability assessments
  • Risk analyses
  • Recommendation for employment
  • Legal assessments

All use of the report is at the customer's own risk. The final decision on employment or other disposition lies entirely with the customer.

7. Abuse of the service

The service may only be used in connection with real recruitment processes or other objective and legal needs.

Manymore reserves the right to suspend access or reject orders in the event of suspicion of abuse or illegal processing of personal data.

8. Information security

Manymore processes personal data in accordance with established security routines and internal procedures.

Data is stored in secure data centers within the EU/EEA, and is transferred and stored with appropriate technical and organizational security measures, including encryption where applicable.

Manymore works in line with established frameworks for information security and quality management.
